If you are involved in a car accident, there are several steps you should take immediately to protect your interests.
- Make sure the accident is reported to the appropriate law enforcement agency. If a law enforcement officer does not prepare an accident report, get an accident report form and fill it out yourself, taking care to be complete and accurate.
- Take photographs of the damage to all of the vehicles involved in the accident, and of the accident scene.
- Report the accident to your insurance agent or insurance company.
- Make sure you collect the names and addresses of any and all witnesses.
- It is likely you will be contacted by adjusters for the companies that insured the vehicles involved in the accident. Do not give a statement to the insurance company for the other driver involved in the accident. Statements taken by adjusters can be used in court, and can be used against you. You do, however, have an obligation to cooperate with your own insurance company. If the adjuster for your insurance company asks you to give a statement or provide information, you should do so promptly and accurately.
- If you are injured, follow the information provided in our resource “steps to take if you are injured in an accident”.
